Daniel A. Hochheiser

Biography:

Mr. Hochheiser, a former prosecutor, is the managing partner of Hochheiser Hochheiser & Inwood LLP. He is a 1996 graduate of Yeshiva University's Cardozo School of Law. After law school, Mr. Hochheiser served as an Assistant District Attorney in Bronx County from 1996 to 1999, where he tried many cases in Criminal and Supreme Courts, including felony narcotics cases www.bronxda.net. Mr. Hochheiser left the District Attorney's Office to join the law firm of Lester Schwab Katz & Dwyer, where he concentrated on the defense of cases involving personal injuries resulting from accidents. He left Lester Schwab to join his father's criminal defense practice which ultimately resulted in the birth of Hochheiser Hochheiser & Inwood LLP.

Mr. Hochheiser is a highly regarded New York City criminal defense attorney. He specializes in criminal trials, appeals and the defense of individuals and small businesses in civil and regulatory matters, including those involving counterfeit products, fraud, labor law violations, discrimination and malicious prosecution.

He has served as defense counsel in a variety of high-profile criminal cases including: the Big Apple "Sex Tour" trial (promoting prostitution) in Dutchess County; the successful resolution of the Manhattan Madam prosecution by plea bargain involving dismissal of the money laundering charges, probation, forfeiture and no additional jail time for client accused of running high end escort services in New York City; the Jeannot “murder-for-hire” trials in Nassau County; the “Evergreen” trial involving charges against a corporate lawyer involving a $30 million financial conspiracy; and the “Golden Venture” trial involving allegations against a well-known Chinese businesswoman of an international conspiracy to launder money and smuggle aliens. Mr. Hochheiser is also well-known for his appellate work including the reversal of the murder conviction in the “Freaky Tah Retaliation Murder” case. Mr. Hochheiser has argued criminal appeals before the United States Court of Appeals for the Second Circuit, and before the First and Second Departments of the Appellate Division of the Supreme Court of the State of New York. Mr. Hochheiser also represents clients in a variety of business litigations in the state and federal courts in New York. Mr. Hochheiser recently served as lead defense counsel for a large Manhattan restaurant in a federal civil trial involving claims by 11 restaurant employees of labor law violations.

Mr. Hochheiser has lectured at CLE programs sponsored by the New York Criminal Bar Association and the New York State Association of Criminal Defense Lawyers on the subject of defending a criminal case involving a false confession.

Mr. Hochheiser has appeared on a variety of television programs concerning high-profile legal issues including Court TV, Fox's "The Factor," CNN's "Anderson Cooper 360," and the syndicated "Inside Edition."

Mr. Hochheiser recently served as Amicus Curiae (friend of the court) for the position taken by a U.S. District Judge in United States v. Gerard Cavera (2d Circuit June 6, 2007 Docket No. 05-4591-cr)(New York Law Journal, June 12, 2007 p22, Decision of the Day: “Gun Sentence Outside Guidelines Range Overturned; Court Wrongly Considered Local Factors in Sentencing”).  Judge Cardamone’s opinion acknowledged Mr. Hochheiser’s work by stating: “Amicus counsel’s exposition of the issues was helpful to us, and we note his commendable candor in advising the Court that his extensive research unearthed scant judicial authority supporting the district court’s sentence.”

Mr. Hochheiser is admitted to practice in the courts of New York State, the United States Courts for the Southern and Eastern Districts of New York, and the United States Court of Appeals for the Second Circuit. Mr. Hochheiser is a member of: the Board of Directors of the New York Criminal Bar Association www.nycrimbar.org, the Association of the Bar of the City of New York www.abcny.org, and the National Association of Criminal Defense Lawyers.
